ICNK 성명서: 중국은 탈북자 가족의 안전한 제 3국행을 보장하라
7명의 북한 일가족이 중국에서 체포돼 북한으로 강제송환 될 경우 고문과 기타 비인간적 유린을 당할 위험에 처해질 거라고 ICNK 측은 우려를 표했다. .
9세 소녀를 포함한 7명의 일가족은 지난 4월 28일에 중국에서 체포된 후 현재 중국 랴오닝성에 구금 중인 것으로 알려진다. 이들 중 일부는 그보다 몇 주 전에 북한을 탈북해 나왔고 다른 일가족은 최근 몇 년간 중국 북부지역에서 생활하던 탈북자들로 알려진다.
휴먼라이츠워치의 필 로벗슨 아시아 부국장은 “만약 이 일가족이 북한으로 돌려 보내진다면 고문과 성폭력, 강제노동과 기타 심중한 유린에 처하게 될 것이다”고 말했다. 덧붙여, “이들에게 안전한 제 3국행이 주어져야 한다"고 강조했다.
북한 법체계 하에서는 허가 없이 자국을 떠나는 것은 범법행위에 해당된다. 하지만 기존에 북한으로 강제로 송환 됐던 북한주민들은 정치범수용소 또는 기타 구금시설에 수감되는 운명이었다.
이에 세계기독교연대(CSW)의 동아시아 팀장인 베네딕트 로저스는 “이 일가족을 북한으로 강제 송환하는 것은 고문과 구금, 처형 등의 험악한 운명으로 이 사람들을 돌려보내는 것이나 다름없다. 따라서 이는 국제법 하에서 중국의 의무를 저버리는 것이며 중국이 난민불송환 원칙을 위반하는 행위다”라고 주장했다.
ICNK의 권은경 사무국장은 “북한당국이 반인도범죄를 저질렀다는 유엔의 자체적 평가를 고려해 봤을 때, 어떤 탈북민들도 자신의 의지에 반해서 북한으로 강제로 돌려 보내서는 안 된다"고 강조했다. 또 “ 끔찍한 인권유린에 노출될 가능성이 있는 북한으로 탈북자들이 송환되는 일이 없어야 하며 이를 위해 국제사회가 중국정부에 탈북자 송환중단을 촉구해야 한다"고 목소리를 높였다.
ICNK는 40개 이상의 국제적 비정부기구들의 연대이며 2013년에 만들어진 유엔 북한인권조사위원회 (COI)의 설립을 위해 국제적인 애드보커시를 진행했으며 2014년에 COI가 북한이 반인도범죄를 자행했다는 조사 결과를 도출해 내는데 크게 기여했다.
