북한: 반인도범죄 재판이 요구된다

ICNK는 새로운 유엔 보고서의 권고안을 적극 지지한다.

(서울 - 2017년 3월 7일) - 북한반인도범죄철폐국제연대 (ICNK)는 국제사회가 북한당국의 반인도범죄 책임소재를 규명하도록 요청하고 있는 두 건의 새로운 유엔 보고서에 대한 지지를 표명한다.

지난 해 유엔 인권이사회의 요청으로 유엔 최고인권대표사무소(OHCHR)가 선정한 독립적 전문가 그룹은 북한 반인도범죄의 책임규명을 위한 접근방안을 연구할 특수한 권한을 위임받았다. 전문가 그룹은 “심각한 범죄에 대한 조사와 기소는 매우 중대한 사안"이라고 강조하며 “희생자가 보상받을 권리, 희생자와 그 사회가 인권유린에 대해 진상규명할 권리, 유린의 재발방지를 보장할 수 있는 확실한 조치” 등을 요청했다.

휴먼라이츠워치 아시아부국장 필 로버트슨은 “북한당국과 지도자들은 오늘날까지도 지속되고 있는 반인도범죄에 대해 정의의 심판을 받아야 한다"고 말했다. 또한 “독립적 전문가그룹 권고안의 즉각적인 실행을 요청하는 특별보고관의 요구에 유엔 인권이사회는 지체없이 긍정적으로 답변할 것을 촉구한다”고 덧붙였다.

독립적 전문가들은 국제형사재판소 (ICC) 제소 방안과 함께 국제 즉결재판소(ad hoc international tribunal)의 설치를 고려할 필요성에 대해서 강조했다. 국제형사재판소는 중대한 인권유린에 있어서 가장 책임있는 자들에 대해 책임소재를 규명할 가장 중요한 방안이지만 북한의 만연한 반인도범죄의 불처벌 상황을 봤을 때 전문가들은 “북한문제에 특정된 국제재판소는 희생자들의 요구가 해결될 수 있도록 시기적, 지역적, 개인적, 주제별 사법권이 조정될 것을 허락해야한다”고 주장했다.

전 COI 조사위원이자 세르비아 인권활동가 소냐 비세르코(Sonja Biserko)와 방글라데시 대법원의 법률가 사라 호세인(Sara Hossain)으로 구성된 독립 전문가 그룹은 “북한 인권상황의 심각성과 복잡성을 봤을 때 종합적이고 다면적인 접근으로 인권유린을 다룰 것이 요구된다"고 주장했다. 전문가그룹은 유엔인권이사회에 “향후 책임규명의 메커니즘에 활용될 수 있을 핵심적이며 독립적인 데이터베이스를 통해서 북한의 인권실상을 포함한 정보와 증거물들을 받아들이고 저장하며 통합하기 위한 추가적인 자원으로 OHCHR 서울 현장사무소을 강화하도록 강력한 권고안들을 내놨다.”

ICNK 권은경 사무국장은 “북한 인권유린의 책임규명을 완수하기 위한 두 명의 독립 전문가 분들의 노고와 강력한 권고안에 감사드린다"며, “유엔 인권이사회의 모든 회원국들은 이제 OHCHR 서울 사무소의 지원을 강화해야하며 이를 통해 서울 사무소가 가해자의 책임규명을 위한 효과적인 분석을 가능케하고 조사를 확대할 방안들을 지원할 수 있게 될 것이다"라고 강조했다.

또한 신임 북한인권 특별보고관인 토마스 오헤아 퀸타나 (Tomás Ojea Quintana)도 연례보고서를 발표해, “북한의 인권유린, 특히 반인도범죄 혐의를 다루는데 있어서 가해자들의 책임규명이 뒤따라야 한다"고 강조했다. 특별보고관은 인권대화에 북한당국을 포함시면서 책임규명을 추구하는 ‘투트랙 전략'을 요청했다. “투트랙은 양자가 공히 강화돼야 하는데 이중적 접근법은 북한의 인권상황에 있어서 실질적이고 지속적인 향상을 만들어 내는데 필수적”이라고 말했다.

특별보고관은 독립적 전문가 그룹의 권고안을 지지하며 “권고안에 따라 모든 관련 당사자들이 조치를 취할 것과 심각한 인권유린, 특히 반인도범죄에 해당되는 범죄가 더이상 불처벌 되지 않도록 확실히 할 것”을 촉구했다. 퀸타나 보고관은 “인권이사회가 전문가그룹의 권고안을 실행할 것을 촉구하며 “지체 없이 중대한 인권유린의 가해자들이 책임을 지고 진실과 정의에 대한 희생자들의 요구에 따라서 모든 희생자들을 지원할 것”을 요청했다. 덧부여 특별보고관은 유엔의 모든 기구들이 “북한의 심중한 인권상황을 하나가 되어 조직적이고 통일적으로 다룰 것”을 촉구했다.

세계기독교연대 동아시아팀장인 벤 로저스는 “6년 전 40개 이상의 국제 인권단체들이 북한의 반인도범죄에 대한 책임규명과 정의 실현을 위한 특별한 목적 하에 ICNK를 설립하기 위해 모였다. 2013년 유엔 COI의 설립은 아주 의미있는 조치였고 일 년 뒤의 보고서는 책임규명의 길로 향하는 획기적인 시도였다. 독립적 전문가 그룹과 유엔 특별보고관의 요구는 COI의 업적 위에 세워졌고 이제는 국제사회가 확실한 조치를 이끌어 내야 한다. 북한의 반인도범죄를 둘러싼 불처벌 (impunity)의 적폐는 이미 오래 전에 막을 내렸어야 했다"고 주장했다.
