북한반인도범죄철폐국제연대 (ICNK)는 최근 강제북송 된 9명의 탈북 청소년들의 생사에 대해 깊은 우려를 표하는 바이다.
여러 뉴스보도들과 인권활동가들에 의하면, 15세부터 23세 사이의 9명의 탈북 청소년들은 지난 4월 북한을 떠나 중국을 통해 라오스로 들어간 것으로 알려졌다. 5월 10일, 라오스 당국은 이들을 구금했다. 그 후 라오스 당국은 9인의 탈북자들을 중국으로 가는 비행기에 태웠다. 이는 선례가 없는 사건이다. 누군가를 고문을 받을 수도 있는 상황으로 강제로 보내는 행위를 금지하는 일반적인 국제법을 명백히 어긴 일이다. 이 9명의 탈북 청소년들을 북한의 위험 속으로 보낸 것은 결국 1951년에 비준된 난민협약과 고문방지협약을 노골적으로 어기는 행위이다.
중국 정부는 탈북자들을 난민으로 인정하지 않고 이들을 체포하여 강제북송 시키는 정책을 고수하고 있다. 탈북자들과 여러 정보원으로부터 입수한 내용에 의하면, 그렇게 북송 된 사람들은 적절한 식량과 의료 서비스를 보장받지 못하는 강제수용소에 감금되고 고문을 받고, 경비원들에 의해 폭행을 당하는 등 부적절한 대우를 받는 것으로 알려져 있다. 김정은이 2011년 그의 아버지로부터 정권을 승계 받으면서, 북한당국은 국경지역 감시를 더 강화시켰고 탈북자들에 대한 압박 수위를 한층 더 높였다. 북한당국은 가장 기본적인 인권인 이동의 자유를 지속적으로 유린하고 있고, 이는 자국민을 인질로 삼고 있는 행위이다.
이번 사안과 관련하여 ICNK는 다음을 주장하는 바이다.
1) 북한 당국은 이 9명의 탈북 청소년들을 석방하고 그들을 고문하거나 구금하지 않을 것을 공개적으로 약속하라.
2) 라오스 정부는 그들의 행위가 국제 인권법을 어겼다는 사실을 인정하고, 탈북자들에게 임시적인 보호와 은신처를 제공할 것 그리고 그 어떤 상황에서도 그들을 중국이나 북한으로 보내지 않을 것을 공개적으로 약속하라.
3) 중국 정부는 난민협약과 고문방지협약 위반을 중단해야 한다. 또한 협약의 국제적 의무에 규정된 바와 같이 탈북자들에게 임시적인 보호를 제공하고 유엔난민기구에 연결 시켜줘야 하며, 최근 북송 된 9인의 탈북 청소년들이 고문 받거나 구금되지 않도록 북한당국을 압박해야 한다.
4) 한국 정부는 비엔티안의 대사관에서 9인의 탈북 청소년들을 돕기 위해 어떤 행동을 취했는지에 대해 조사 하고 그 결과와 권고들을 공식적으로 발표해야 한다.
